Content

  • Introduction to the method of comparative law in general as a fundamental instrument for the contemporary lawyer.
  • Aspects of the evolution of the system of Civil Law and Common Law.
  • References from the Roman tradition as a basis of European law.
  • Canon Law and Civil Law: contacts and cross-references.
  • Contracts and the general theory about contracts.
  • Aspects of Islamic Law and the Islamic theory about contracts.
  • The fiducia and the Trust.
  • The marriage and patrimonial relationships between the spouses.
  • Testament and inheritance
  • Aspects of civil procedure (litigations).
  • References from International private law.

Scope

To introduce the student to the comparative juridical method through the analysis of some of the major juridical institutes of private law. To show the relation between Canon Law system and Civil law.
